INTERNATIONAL CONSORTIUM FOR HEALTH OUTCOMES MEASUREMENT (“ICHOM”) WELCOMES YOU TO THE ICHOM CONFERENCE 2024 (THE “EVENT”). ICHOM PROVIDES THE EVENT TO YOU, YOUR EMPLOYEES, AGENTS, AND CONTRACTORS, AND ANY OTHER ENTITY OR PERSON ON WHOSE BEHALF YOU ACCEPT THESE TERMS (COLLECTIVELY “YOU”), SUBJECT TO THESE ATTENDEE TERMS & CONDITIONS (“TERMS”). THESE TERMS ARE ENTERED INTO BY AND BETWEEN ICHOM AND THE ENTITY THAT EMPLOYS YOU OR ENGAGES YOU, IF ANY, OR YOU AS AN INDIVIDUAL IF THERE IS NO SUCH ENTITY (AND REFERENCES TO “YOU” OR “YOUR” HEREIN REFER TO SUCH ENTITY OR YOU, AS APPLICABLE), AND YOU ACCEPT THEM AND AGREE TO BE BOUND BY THEM BY: (I) SIGNING UP FOR AN ACCOUNT ON THIS WEBSITE; (II) REGISTERING FOR THE EVENT VIA THIS WEBSITE; (III) ACCEPTING AN INVITATION TO THE EVENT; (IV) CONSENTING TO A THIRD PARTY REGISTERING YOU FOR THE EVENT; (V) ORDERING OTHER GOODS OR SERVICES VIA THIS WEBSITE; (VI) USING THE WEBSITE; OR (VII) ATTENDING THE EVENT. THE INDIVIDUAL ACCEPTING THESE TERMS REPRESENTS TO ICHOM THAT SUCH INDIVIDUAL HAS THE RIGHT TO AGREE TO THESE TERMS ON BEHALF OF YOU. THROUGHOUT THESE TERMS, ANY REFERENCE TO “WE”, “US”, OR “OUR”, OR ANY SIMILAR EXPRESSION, EXCEPT WHERE THE CONTEXT REQUIRES OTHERWISE, REFERS TO ICHOM.
Please read these terms carefully, as they include an agreement to arbitrate, which requires you, your attendees and ICHOM to arbitrate certain claims by binding, individual arbitration instead of going to court, and limit class action claims, unless you out of the agreement to arbitrate, as set forth below.
Description of Services
The Event will take place on 21 and 22 October 2024. This website provides access to an account, registration, any Virtual Sessions and other services for the Event, including without limitation information regarding promotional, sales, sponsorship and networking opportunities for those companies doing business in the healthcare or technologies (“Services”).
Eligibility
The individual agreeing to these terms represents and warrants to us that such individual is at least 16 years of age. You agree to be bound by these terms and to indemnify ICHOM for any violation of these Terms by any individual employed or engaged by You. You represent and warrant to us that You have registered to attend the Event having only used a registration code that You are authorised to use.
ICHOM, the Event organizer, is an organization that is organized in the United States of America and therefore must comply with U.S. sanctions law. You represent and warrant to us that neither You nor any of Your Attendees (as defined below) (i) are currently on the U.S. Department of the Treasury’s Office of Foreign Assets Control (OFAC) List of Specially Designated Nationals and Other Blocked Persons (including terrorists and narcotics traffickers) (the “OFAC List”); (ii) are affiliated with any entity or organization on the OFAC List; or (iii) are on any similarly restricted party listings, including without limitation those maintained by other governments pursuant to applicable United Nations, regional or national trade or financial sanctions. If You, any of Your Attendees or any entity or organization with which You are affiliated, are added to any such restricted party list prior to the Event, then You must notify us immediately. The OFAC List can be found by visiting http://www.treasury.gov/resource-center/sanctions/SDN-List/Pages/default.aspx. ICHOM may cancel or terminate these Terms (and any access granted to You to the Event or Services) without penalty or liability if we reasonably believe it is necessary to do so in order for us to comply with our obligations under such applicable laws or regulations, including if You are added to any restricted party listings as described in this section. Cancellation or termination under this provision will result in forfeiture of all fees paid by You, in conformance with U.S. sanctions law.
Payment
All payments must be made in Euros. Admission to the Event will not be granted without payment in full received by the applicable due date. ICHOM’s receipt of: (i) an application for registration; or (ii) You making a payment for registration does not constitute ICHOM’s acceptance of Your offer to register for the Event. Applications and payments that are not accepted by ICHOM will be returned. Whether or not ICHOM accepts Your application shall be in ICHOM’s sole discretion.
Currency Exchange Rate Disclaimer: You confirm acknowledgment and acceptance of a potential gain/loss incurred by any adjustments made by Your bank due to the currency exchange rate. ICHOM will not be liable or responsible for any loss incurred by You from an adjustment made due to the currency exchange rate. Nor will ICHOM pursue You for collection if that adjustment should be made in Your favor.
Cancellations
If any of Your Attendees can no longer attend the Event, Your Attendee may cancel Your Attendee’s registration by providing written notice to the ICHOM team at events@ichom.org. We will not be obligated to refund You any amount of the registration fee for the Event and, if You still have a balance due, You agree to pay any such balance due promptly. Except as set forth above, You will liable for the full cost of Your Attendee’s admission to the Event and any additional Services related to the Event notwithstanding a subsequent cancellation or Your Attendee’s failure to attend.
You are solely responsible for cancellation of travel or hotel reservations, if applicable, if You do not attend any In-Person Session of the Event. If You have booked your accommodation for the ICHOM Conference through our website, after 1 September Your accommodation booking will no longer be refundable.
ICHOM reserves the right to cancel Your registration without notice if (i) payment as required by these Terms is not received by ICHOM in a timely fashion, (ii) You fail to provide details as required in the relevant registration form, or (iii) You are in violation of any of these Terms or any other applicable terms and conditions. You agree that ICHOM is not responsible for any damages, direct or indirect, resulting from any cancellation. All payments must be submitted within the time frames set forth in the relevant registration form.
Should ICHOM postpone the date, change the format or change the location of any session or element of the Event, registered attendees who have paid the registration fees in full for the Event will be provided with admission to any substitute or modified session.
To the maximum extent permitted by applicable law, you agree in no event shall ICHOM be liable to you or any third party for any consequential, punitive, incidental, special, multiple or other indirect damages resulting from a postponement, cancellation, or termination, including without limitation any costs or expenses of travel and accommodations. No costs, including but not limited to travel or accommodations, will be refunded for any reason whatsoever, except to the extent otherwise set forth herein.
Identification
For any In-Person Session, if applicable, You shall require each of Your Attendees to carry at all times during the Event, government issued photo identification in the form of a passport, national ID card or the like, and to produce such identification to: (i) collect an attendee badge (including any replacement badge); (ii) enter the Event venue; (iii) upon request.
Each of Your employees or contractors that attends any In-Person Session (collectively, “Your Attendees”) must personally submit appropriate identification information. Any submission of identification information by any person other than the individual identified in the materials constitutes a material breach of these Terms.
You understand that You are solely responsible for the accuracy of all personal data provided to us. Failure to enter accurate data may result in adverse consequences, including without limitation failure to receive critical information or the inability to reset account passwords. ICHOM is not liable for any damages that may result from the submission of incomplete or inaccurate information. Do not disclose any account information to any third party. You are solely responsible for any action or omission undertaken using any account information of any of Your Attendees.
Substitutions
Requests for substitution of a registered Event attendee with an alternative person must be made in writing to info@ichom.org. Such requests shall be approved or denied by ICHOM in its sole discretion. Such requests should include (i) the registered Event attendee’s full name and registration number, (ii) evidence of permission of the original registered Event attendee to allow substitution of an alternative person, and (iii) the name and email address of the proposed substitute registrant. The cost of substituting a registered Event attendee will vary based on registration status of the original attendee. Any balance due will automatically be transferred to the substitute. Substitutions between attendees from the same company and at the same invoice address may be made by providing ICHOM with written notice of the name of the original delegate and full details of the substitute registrant. Once a badge for a named Event attendee has been issued, no substitutions will be permitted.
Pass/Pass Code Sales
The pass or pass code we provide is personal to each of Your Attendees. Sale of Event passes other than directly from ICHOM is strictly prohibited. If Your pass or pass code was given to You by an exhibitor, sponsor, advertiser or other party which properly acquired the pass from ICHOM, that pass or pass code is personal to You, and may not be sold, given, published or otherwise transferred without express permission of ICHOM. If You sell any pass or pass code, purchase a pass or pass code from any person or entity other than ICHOM, publish or distribute any code such that others may use such pass or pass code without appropriate authorization, or in any way work to facilitate access (including Your own) to the Event by any dishonest means, in ICHOM’s sole discretion, You may be prohibited from participating in the Event, ejected from the Event and barred from attending any other ICHOM event permanently.
Visas & Travel Authorisation
For any In-Person Session, if applicable, You are responsible for arranging any appropriate travel authorisation to travel to, or gain entry, into the country where any In-Person Session is taking place for each of Your Attendees. You are responsible for any cost associated with obtaining any such authorisation. ICHOM shall not compensate You, nor shall refunds be issued, in the event of any inability to attend the Event due to lack of any necessary travel authorisation. You are responsible for ensuring you adhere to all requirements in place relating to, but not limited to, Covid-19 restrictions.
ICHOM Trademarks and Logos
Registering for and attending the Event does not grant You any rights to use the name of the ICHOM or any of ICHOM’s logos or trademarks. The Services or any associated material provided by registering or attending the Event, including any image, design, photograph, writing, graph, data or other context, are the property of ICHOM and are protected by international copyright, trademark, trade secret or other proprietary rights.
Recordings
By attending this Event, You agree to the following, and shall require each of Your Attendees to comply with the following:
You agree that a breach of any of the above terms may lead to evictions of each of Your Attendees from the Event venue. You or any of Your Attendees, as determined by ICHOM, may not be allowed to re-enter the Event or any future event organized by or on behalf of ICHOM.
During any In-Person Session or Virtual Session, You consent to ICHOM or any of its agents making recordings of each of Your Attendees (and You shall obtain such consent from each of Your Attendees to make such recordings) by any means including without limitation electronic recording, film, videotape, audio tape or photography (the “Recordings”) without compensation of any kind to You or any of Your Attendees. You agree that ICHOM shall be the copyright owner of each of the Recordings. You understand that ICHOM is not obligated to use any Recording.
To the best of Your knowledge, no act or statement contained in any Recordings will violate any right of any person or entity or defame any person or entity.
You also understand that any third party attending the Event may capture Your image by any means including, without limitation electronic recording, film, videotape, audio tape and photography. By attending the Event, You consent, and shall obtain the consent of each of Your Attendees, to the capture of the image of each of Your Attendees without compensation to You or any of Your Attendees and You release, and shall require each of Your Attendees to release, such any third party from any claim or cause of action that You or any of Your Attendees may have now or in the future including without limitation defamation, invasion of the right of privacy, publicity or personality, copyright or trademark infringement or unfair competition.
You release, and shall require each of Your Attendees to release, ICHOM from any claim or cause of action that You or any of Your Attendees may have now or in the future based upon defamation, invasion of the right of privacy, publicity or personality, copyright or trademark infringement or unfair competition in connection with any Recording or ICHOM’s use of any Recording and You agree not to institute any legal action against ICHOM or any other party attending the Event in connection with any Recording based on any grounds, whether or not specified in this section.
All of the rights granted to ICHOM by You hereunder are irrevocable and perpetual, and You waive all rights to any equitable relief in connection with the Terms.
Data Collection
By purchasing an ICHOM delegate pass, you allow ICHOM to share information such as your name, your job title and your organization with other delegates in relation to the ICHOM 2024 event. You are permitted to collect personal and contact information from other attendees and exhibitors that is publicly available or that is voluntarily provided to You. You may use this information for internal purposes only. In no event are You permitted to share all or part of this information with any third party (which includes without limitation the sale of any such information to any third party).
Prohibited Activities
As a condition of Your or Your Attendees use of our Services, You shall not, and shall require each of Your Attendees not to, use our Services for any purpose that is unlawful or prohibited by these Terms. You agree to comply with any other applicable terms and conditions of use set forth on our Services.
You shall not engage in, and shall require each of Your Attendees to refrain from, attending the Event as an attendee but soliciting business from any other attendee or exhibitor, or setting up events at a location other than any Event venue that encourages any attendee to leave any such Event venue. You agree that You will not plan or attend or otherwise participate in such an event that takes place (i) during the Event or (ii) in the three (3) days before and after the Event. You will not engage in or support the aforementioned activities in any way.
We may cancel the registration of any of Your Attendees if any of Your Attendees engages in any activity prohibited in this section, without providing You or any of Your Attendees a refund.
Virtual Sessions
We may offer some or all aspects of the Event through Virtual Sessions. Any Virtual Session may periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons. In order to access any Virtual Session, You must have a computer with Internet access that can access such Virtual Session or a compatible mobile device enabled with any mobile application we may provide. When accessing any Virtual Session, Your telecommunications carrier’s normal rates and charges apply. We are not responsible for any charges You incur from Your telecommunications carrier as a result of any Virtual Session. You are responsible for ensuring that, at all times while accessing any Virtual Session, You are not in violation of Your agreement with Your telecommunications carrier.
By participating in any Virtual Session, You agree that You will not, and shall require each of Your Attendees not to, use our Services in any manner that in our sole discretion could damage, disable, overburden, impair or interfere with any other party’s participation in any Virtual Session. You may not obtain or attempt to obtain any information through any means not intentionally made available through any Virtual Session. In the event that You gain access to information not intended to be accessed by You, You agree that You will immediately notify us and destroy all copies of such information in Your possession.
You are responsible for any content that You share with presenters or other participants during any Virtual Session. You agree not, and will not permit any of Your Attendees or any other person or entity, to: (i) use, or allow the use of, any Virtual Session for any unfair or deceptive practices or in contravention of any federal, state, local, foreign or other applicable law or rules and regulations of regulatory or administrative organizations; (ii) act in a fraudulent, tortious, malicious or negligent manner when accessing any Virtual Session; (iii) obtain unauthorized access to any computer system through any Virtual Session; (iv) circumvent, remove or otherwise interfere with any security-related features of any Virtual Session, features that prevent copying or using any part of any Virtual Session or features that enforce limitations on the use of any Virtual Session or any content shared or accessed in connection therewith; (v) introduce viruses, worms, Trojan horses or harmful code to any Virtual Session; and (vi) use any robot, spider, site search/retrieval application or other automated device, process or means to access, retrieve, scrape or index any portion of any Virtual Session or content in connection therewith.
In addition, You agree that You will not, and will not authorize or facilitate any attempt by Your Attendees or another person or organization to use any Virtual Session to: (i) transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, offensive, obscene, pornographic, lewd, lascivious or otherwise objectionable, as determined by us; (ii) use a name or language that we, in our sole discretion, deem offensive; (iii) post defamatory statements; (iv) post hateful or offensive content or content that disparages any ethnic, racial, sexual, gender, religious or other group; (v) post content that depicts or advocates the use of illegal drugs; (vi) post content that characterizes violence as acceptable, glamorous or desirable; (vii) post content which infringes another’s copyright, trademark or trade secret; (viii) post unsolicited advertising or unlawfully promote products or services; (ix) harass, threaten, bully, stalk or intentionally embarrass or cause distress to another person or entity; (x) promote, solicit or participate in any multi-level marketing or pyramid schemes; (xi) exploit children under 18 years of age; (xii) engage in disruptive activity, such as sending multiple messages in an effort to monopolize a forum; (xiii) invade the privacy of any person, including without limitation posting personally identifying or otherwise private information about a person without their consent (or their parent’s consent in the case of a child under 18 years of age); (xiv) solicit personal information from children under 18 years of age; (xv) create a false identity or impersonate another person or entity; or (xvi) encourage conduct that would constitute a criminal or civil offense. The restrictions in this paragraph are intended to be illustrative, and we reserve the right to consider other conduct to be prohibited.
You agree and acknowledge that each Virtual Session is proprietary to us. You shall not, and shall not permit any of Your Attendees or any person or entity to: (i) alter, enhance or make derivative works of any Virtual Session or any content available through the foregoing; or (ii) reverse engineer, reverse assemble or decompile or otherwise attempt to derive source code from any Virtual Session or any technology through which any Virtual Session is provided. You shall not sell, transfer, publish, disclose, display or otherwise make available access to any Virtual Session or any content provided in connection therewith including any modifications, enhancements, derivatives and other software and materials provided hereunder by us or copies thereof to others in violation of these Terms. Unless otherwise noted, all content shared through any Virtual Session is the property of us and/or our conference presenters, and is protected from unauthorized copying and dissemination by United States copyright law, trademark law, international conventions and other intellectual property laws. ICHOM is not liable for the detailed content of any Virtual Session or if the content of any Virtual Session did not entirely meet expectations.
We may provide access to any Virtual Session through a third party service provider. We have no control over any features or functionalities offered by any third party, and those features or functionalities may be modified, suspended or terminated at any time with no notice. You may be required to accept separate terms and conditions of any such third party service provider as a condition of obtaining access to any such Virtual Session. You hereby acknowledge and agree that any such third party service provider: (i) is not a party to these Terms; (ii) has no obligation whatsoever to furnish any maintenance or support services with respect to any Virtual Session; (iii) is not responsible for addressing claims by You or any third party relating to any Virtual Session, including without limitation any product liability claims, claims under consumer protection laws or claims under any other law, rule or regulation; and (iv) has no responsibility to investigate, defend, settle or discharge any claim that any Virtual Session infringes any third party intellectual property rights.
Safety and Security
ICHOM is not responsible for any lost or stolen item. Please remain aware and keep personal possessions, including without limitation passports, electronics or financial instruments secure at all times. For the safety and security of all attendees, ICHOM reserves the right to enable security personnel to perform security checks of any attendee at any time. ICHOM reserves the right to refuse admittance or remove any attendee from any Event venue, entry points or offsite location controlled by ICHOM at any time, without liability.
Anti-Harassment Policy
ICHOM is dedicated to providing a positive, harassment-free event experience for all participants and staff, regardless of gender, gender identity or expression, sexual orientation, disability, physical appearance, race, age or religion. ICHOM does not tolerate harassment of any event participant or staff in any form. The use of harassing language or imagery (including without limitation that of a sexualised nature) is not appropriate at any ICHOM event or related social activity sponsored or organised by ICHOM. Any event participant found to be violating this policy may be sanctioned or expelled without a refund at ICHOM’s sole discretion.
Smoking/E-Cigarettes
For any In-Person Session, if applicable, smoking, including the use of smokeless tobacco products, e-cigarettes or unregulated nicotine products, is strictly prohibited except in designated areas.
Children
Any individual under 16 years of age (including infants) is not permitted entry to the Event venue during build-up, dismantling or on Event days. Any exceptions to this policy are in the sole discretion of the organiser of the Event and permission must be provided by the organiser, in writing, prior to start of the Event. Requests for exceptions cannot be made onsite.
Voluntary Participation
Any of Your Attendees may volunteer or be asked to participate in any demonstration or exhibit during the course of the Event. Any participation by any of Your Attendees in such a demonstration or exhibit is on a voluntary basis and is not a requirement. Any of Your Attendees may purchase or be invited to participate in hospitality offerings by any third party and such offerings may include high risk activities, including without limitation flights in a hot air balloon, helicopter or bi-plane ride or other activities which carry risk to any person or property. You understand that any of Your Attendees participate in such demonstrations, exhibits and hospitality offerings entirely at Your own risk. ICHOM is not responsible or liable for any injury or damage any of Your Attendees may suffer as a consequence of participating in such demonstration or exhibit other than to the extent such injury or damage is caused by ICHOM’s gross negligence or wilful misconduct. ICHOM expressly disclaims any liability whatsoever for injury or damage caused to You by Your participation in hospitality offerings provided by any third party.
Term and Termination
This agreement is effective until terminated by ICHOM or until the end of the Event, whichever comes first. You agree that ICHOM may terminate these Terms at any time, for any or no reason, without notice, in ICHOM’s sole discretion. In the event of termination, neither You nor Your Attendees are authorised to attend or continue to attend the Event. You agree that ICHOM shall not be liable to You or any third party for any termination of Your access to the Services, unless otherwise stated herein.
Privacy and Data Protection
At ICHOM, we take privacy and data protection seriously. Because ICHOM is dedicated to serving Your needs and respecting Your preferences, ICHOM has adopted the policies and practices described in these Terms and Conditions, in the Privacy Policy available at https://www.ichom.org/privacy-policy/. The Privacy Policy will be updated when necessary to reflect changes in products and Services. ICHOM encourages You to periodically review the Privacy Policy to learn how ICHOM is protecting information of Your Attendees.
In general, ICHOM collects and uses information about You or Your Attendees in connection with the provision of the Services, for account administration and for communicating with You about the event. We may also use this information to help ICHOM understand Your needs and interests to better tailor our products and Services to meet Your needs.
When any of Your Attendees registers for an Event or conference through our website, we ask for Your Attendee’s name, email address, phone number, job title and company name and country of residence. We use personal data to provide Your Attendees with information and Services associated with the Event or conference. We may also use Your Attendees’ personal data to contact Your Attendees about other events, conferences or ICHOM news that may be of interest to Your Attendee. We may also ask any of Your Attendees to provide, at such of Your Attendee’s option, information about any dietary requirements or allergies and any medical conditions. None of Your Attendees is required to provide this information and we will only use this information to accommodate Your Attendee’s needs at the Event.
In order to facilitate networking and business relationships at any In-Person Session, if applicable, any exhibitor may wish to scan Your Attendee’s badge so such exhibitor can contact Your Attendee with more information. ICHOM uses technology to provide badge scanning services to exhibitors who request it. By allowing an exhibitor to scan Your Attendee’s badge, Your Attendee is consenting to have the chosen technology provide the exhibitor with Your Attendee’s contact information (name, job title, company, email address, mobile number, country), and thereafter Your Attendee may be contacted by the exhibitor post-event. If Your Attendee does not wish the exhibitor to contact Your Attendee or to exercise any data subject rights, please communicate this directly with the exhibitor at the event or thereafter. In order to facilitate networking ICHOM may introduce an event app which will enable Your Attendees to connect with other attendees. If Your Attendee does not wish to participate, please communicate directly with ICHOM.
Except as described herein and in the Privacy Policy, ICHOM does not sell, rent or otherwise share or disclose Your Attendee’s private, personally identifiable information to any third party.
Because of the nature of ICHOM’s business, the Services and benefits are not designed to appeal to minors. ICHOM does not knowingly attempt to solicit or receive any information from children.

Accuracy of Content

The Entire Risk Arising Out Of Your Attendees’ Attendance At The Event Remains With You.
If ICHOM, Its Affiliates And Licensors Or Any Of Its Or Their Officers, Directors, Employees, Agents, Third-Party Content Providers, Licensors Or The Like, Are Liable To You For Any Reason, Liability Will Be Limited To The Amount Paid By You For The Services In The Year In Which Such Liability Arose. Nothing In This Agreement Shall Limit Or Exclude ICHOM’s Liability For The Following: (I) Death Or Personal Injury Resulting From Its, Its Employees’ Or Its Sub-Contractors’ Negligence; Or (Ii) Any Other Liability That Cannot Be Excluded By Law. To The Maximum Extent Permitted By Applicable Law, You Agree In No Event Shall ICHOM Be Liable To You Or Any Third Party For Any Consequential, Punitive, Incidental, Special, Multiple Or Other Indirect Damages Arising Out Of Or Relating To These Terms. You Agree That Any Action Must Be Commenced Within One (1) Year After The Claim Or Cause Of Action Arises.
Indemnification
You agree to indemnify, defend and hold harmless ICHOM, its affiliates and licensors or any of its or their officers, directors, employees, agents, third-party content providers, licensors or the like from and against any claim or expense, including reasonable attorneys’ fees, arising out of or related to attendance at this Event, violation of these Terms, violation of any law or regulation, or violation of any proprietary or privacy right or any of Your Attendee’s participation in a hospitality offering provided by any third party in relation to the Event.
Force Majeure
In the event that ICHOM is prevented from carrying out its obligations as a result of any cause beyond its control, including without limitation acts of God, war, acts of terrorism, disease or pandemic, virus propagation, airline flight cancellations, strikes, lock-outs, flood or failure of any third party to deliver goods or services, ICHOM shall be relieved of its obligations or liabilities for as long as (i) fulfilment is prevented, or (ii) performance becomes impossible.
Modifications to the Terms
The Terms are subject to change without notice and may be revised or updated from time to time in ICHOM’s sole discretion. All amended terms shall automatically be effective immediately when posted on this website, and shall apply to all access to the Event and use of any website, app or Services in relation to the Event thereafter. You agree that You are responsible for periodically returning to this website and reviewing these Terms to understand the current Terms. ICHOM does not and will not assume any obligation to notify You of changes to the Terms, although we will generally notify You of any material updates to these Terms. Your continued use of any website, app or service, or attendance at the Event, means that You accept and agree to the changes. Except as outlined herein, the Terms may not be otherwise amended except in a writing signed by You and us.
Survival
The following Sections survive any termination of the Terms: ICHOM Trademarks and Logos, Privacy and Data Protection, Voluntary Participation, Your Collection of Attendee and Exhibitor Data, Eligibility, No Warranty; Limitation of Liability, Indemnity, Agreement to Arbitrate; Waiver of Class Action, and this Survival Section.
Entire Terms
These Terms constitute the entire agreement between ICHOM and You with respect to the Event, and supersede any prior or contemporaneous communication or proposal, whether electronic, oral or written, between You and ICHOM with respect to the Event. However, there may be legal notices on other areas of this website that relate to the ordering of goods and services, all of which will, together with these Terms govern Your ordering of Services. A printed version of the Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. If for any reason a court of competent jurisdiction finds any provision of the Terms or portion thereof to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of the Terms, and the remainder of the Terms shall continue in full force and effect. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
ICHOM Connect
In connection with the Services, ICHOM may choose to provide You or Your Attendees with access to ICHOM Connect, https://connect.ichom.org. In order to access ICHOM Connect, You will be required to accept the terms and conditions of ICHOM Connect, as may be in effect from time to time.
Electronic Communications and Electronic Signatures
You agree to be bound by any affirmation, assent or agreement You or any of Your Attendees transmit through this website or an app associated with the Event, including without limitation any consent You give to receive communications from ICHOM solely through electronic transmission. You agree that when in the future You click on an “I agree”, “I consent”, or other similarly worded “button” or entry field with Your mouse, keystroke or other computer device, Your agreement or consent will be legally binding and enforceable and the legal equivalent of Your handwritten signature.
General
You understand that pursuant to safety and other regulations which ICHOM must comply with, presentations, seminars or sub-events (collectively, “Sub-Events”) within the Event will each be subject to applicable maximum capacity limitations. You agree that entry to Sub-Events shall be permitted on a “first come, first served” basis and that once the space allocated for a Sub-Event is full, Your Attendees shall not be permitted entry.
ICHOM’s failure to exercise or enforce any right or provision of the Terms of use shall not constitute a waiver of such right or provision unless acknowledged and agreed to by ICHOM in writing. The section titles in these Terms are solely used for the convenience of the parties and have no legal or contractual significance. ICHOM reserves the right at any time to make changes or corrections and to alter, suspend or discontinue any aspect of any of the Services for which You have registered. If ICHOM exercises its right to withdraw, ICHOM may at its option offer You broadly equivalent replacement Services or refund Your payment which shall constitute a final settlement of any dispute between You and ICHOM, and shall discharge any and all liability of ICHOM to You. Notices to You may be made via either e-mail or regular mail. Information sent to You pertaining to the Services may also provide notices of changes to the Terms or other matters, by displaying such notices or by providing links to such notices.
ICHOM reserves the right, in its sole discretion, to limit or deny access to the Event venue to any person or entity. You must be at least sixteen (16) years of age to gain access to the Event venue without prior approval from the ICHOM.
Governing Law
The construction, validity and performance of the Terms are exclusively governed by the laws of the England and Wales without reference or regard to principles of conflicts of law. The parties submit to the exclusive jurisdiction of the courts of England and Wales, located in London. If any provision of the Terms are held by a court of competent jurisdiction to be invalid or unenforceable such holding shall not affect any other provision hereof, and the Terms shall be construed as if the invalidated or unenforceable provision had not been contained herein.
